The Environmental Assessment Act (EAA) provides for the betterment of the people of Ontario through the protection, conservation and wise management of the environment. It applies to activities or projects of public bodies, and major commercial or business undertakings of non-public entities, if designated by regulation.
Regulations Made under the Environmental Assessment Act
Regulation 334 identifies public bodies and agencies which are either subject to or exempt from the EAA as well as exemptions and inclusions of particular undertakings. The regulation also identifies additional information requirements related to the submission of an environmental assessment (EA).
O. Reg. 101/07 clarifies and modifies EA requirements for waste diversion and disposal facilities such that private and public sector projects are now equally subject to the EAA.
O. Reg. 116/01 modifies the EA requirements for new electricity projects such that private and public sector projects are now equally subject to the EAA.
O. Reg. 616/98 establishes deadlines associated with EAs including Minister's decisions, public notice of submission of an EA, and comment periods on an EA.
O. Reg. 345/93 requires that the private sector developers undertaking road, water or sewer projects servicing residential developments under Schedule C of the Municipal Engineers Association Municipal Class EA shall complete the same process as a municipality would for those same activities.
The Environmental Protection Act provides for the protection and conservation of the natural environment. It establishes the powers to prohibit the discharge of contaminants into the natural environment that causes or is likely to cause an adverse effect. The Ontario Water Resources Act provides for the protection of Ontario's water resources. It establishes powers to regulate the taking of water, and the establishment of water works and sewage works. Regulations made under the Ontario Water Resources Act.
The Safe Drinking Water Act provides for the protection of human health and the prevention of drinking-water health hazards through the control and regulation of drinking-water systems and drinking-water testing.
