FAZAL RAJA AND WASTE LIQUID HAULING INC. FINED $13,000 FOR ILLEGAL DUMPING OF LIQUID WASTE

CALEDON Fazal Raja and Waste Liquid Hauling Inc. pled guilty and were fined a total of $13,000, plus a victim surcharge fee, for violating the Environmental Protection Act.

Waste Liquid Hauling Inc. is a company located in Brampton.  Fazal Raja is the President of Waste Liquid Hauling Inc. 

The Court heard that under its Certificate of Approval, the company was permitted to collect, handle and transport certain non-hazardous liquid wastes, but was not entitled to handle sewage, including sewage made up of septic tank liquid.  On the evening of November 4, 2006, Mr. Raja used a vacuum truck to pump out sewage waste from a septic tank in Caledon.  This work was not allowed under the Certificate of Approval.  Mr Raja emptied the truck’s tank onto the side of the road.  Neither the road, the field adjacent to it, nor the drainage ditch was an approved waste disposal site. 

Fazal Raja and Waste Liquid Hauling Inc. were charged following an investigation by the Ministry of the Environment’s Investigations and Enforcement Branch.

Fazal Raja and Waste Liquid Hauling Inc. pled guilty to one count of acting contrary to section 40 of the Environmental Protection Act by depositing waste on a site that is not approved.  Fazal Raja and Waste Liquid Hauling Inc. also pled guilty to failing to comply with the Certificate of Approval, contrary to section 186(3) of the Environmental Protection Act.  Fazal Raja was fined $5,000, plus a victim surcharge, and given 12 months to pay.  Waste Liquid Hauling Inc. was fined $8,000, plus a victim surcharge, and given 18 months to pay. 

Justice of the Peace Vernon A. Chang Alloy heard the case in the Ontario Court of Justice in Caledon, Ontario, and imposed sentence on November 1, 2007.
