WHITBY — Michael Baumchen has been sentenced to 90 days incarceration for failing to comply with three conditions of a Provincial Court Order stemming from a previous conviction under the Environmental Protection Act.
On November 26, 2003, Michael Baumchen was convicted under the Environmental Protection Act for failing to comply with an order to clean-up a property and for operating a waste management system without a Certificate of Approval. As part of sentencing, a Court Order under the Environmental Protection Act was imposed against the defendant with conditions relating to and prohibiting further acceptance or burning of wastes and requiring the removal of illegally stored wastes. Subsequent inspections by the Ministry of the Environment confirmed that conditions of the Court Order were not complied with.
Michael Baumchen was charged following an investigation by the Ministry of the Environment’s Investigations and Enforcement Branch.
Michael Baumchen pleaded guilty on June 20, 2007 and was convicted of failing to comply with three conditions of the Court Order. On November 27, 2007 Mr. Baumchen was sentenced to a total of 90 days incarceration for the offences committed. The court ordered that the sentence be served intermittently on weekends.
Justice of the Peace Robert G. Boychyn sentenced the defendant in the Ontario Court of Justice in Whitby.
