OTTAWA — Santaro Development LLC has been fined $10,000 plus a victim fine surcharge, and Waste Services (CA) Inc. has been fined $7,500 plus a victim fine surcharge, after pleading guilty on November 13, 2008 to violations under the Environmental Protection Act.
Santaro Development LLC pleaded guilty to operating a Waste Management System without a Certificate of Approval, and Waste Services (CA) Inc. pleaded guilty to arranging for the use of equipment, namely transport trucks, for the handling and transportation of waste that was not part of a Waste Management System for which a Certificate of Approval had been issued. The companies were given 60 days to pay.
The Court heard that Santaro Development LLC is a New York Based trucking company. Waste Services (CA) Inc. is an Ontario company that operates waste disposal sites, transfer facilities and waste management systems, including a facility in Ottawa. During a ministry surveillance program, Santaro trucks were observed crossing the border into Canada, picking up waste at the Waste Services facility in Ottawa, and crossing back into the United States to dispose of the waste. At the time, Santaro did not have an approval from the ministry for a Waste Management System, and Waste Services did not ensure that Santaro had the necessary approval prior to arranging for it to transport waste from its facility.
