NORTH BAY - Dale Cecil Brooks has been fined $20,000 plus a victim fine surcharge, after pleading guilty on November 14, 2008 to two violations under the Environmental Protection Act for failing to retain an approved contractor to remove waste from his property and for failing to complete the removal of all waste from his property. He was given six months to pay the fine.
The Court heard that Mr. Brooks owns property in the Township of East Mills in the District of Parry Sound from which he operates a road construction business. In February 2005, Mr. Brooks was convicted of operating a waste disposal site at the East Mills property without a Certificate of Approval and failing to remove the waste which had been deposited on the property. Pursuant to his conviction, he was issued a Court Order to prevent the site from being used for waste disposal, and requiring removal of the waste. Subsequent inspection by ministry staff found that the site had not been cleaned up.
Mr. Brooks was charged following an investigation by the Ministry of the Environment’s Investigations and Enforcement Branch.
Mr. Brooks has now cleaned up the site at a cost of $237,000.
