BARRIE — Simcoe Pump & Well Drilling Inc. has been fined $25,000, and Lawrence Maltby has been fined $5,000, plus both fined a victim fine surcharge, after pleading guilty on December 2, 2008 to discharging contaminants, namely water and soil, into the environment which caused an adverse effect, contrary to the Environmental Protection Act. The parties were given 15 months to pay.
The Court heard that Simcoe Pump & Well Drilling Inc. is in the business of constructing water wells. Mr. Maltby is the President of the company. Inspection by the ministry at a property in Minesing found that a well installed by Mr. Maltby had been discharging silt and sand laden water at a high flow rate. It was observed that the water with silt and sand caused considerable damage to the well owner’s property and dwelling, and it also impacted a neighbouring farm field.
Simcoe Pump & Well Drilling Inc. and Mr. Maltby were charged following an investigation by the Ministry of the Environment’s Investigations and Enforcement Branch.
