ST. CATHARINES – On October 23, 2009, Trensept Automation Inc. was fined $100,000 plus a victim fine surcharge for failing to comply with its Provisional Certificate of Approval for the operation of a waste disposal site.
The Court heard that the company had a Provisional Certificate of Approval for a waste disposal site in St. Catharines. The certificate included conditions that limited the amount of tires on site, required compliance with the fire code, required the site to be secured at all times and required the submission of a cleanup and closure plan. In March 2007, the ministry discovered that the site had been abandoned with a significant amount of tire and tire crumb present, no fire monitoring or protection system and improper security.
The company was charged following an investigation by the ministry’s Investigations and Enforcement Branch.
The company was convicted in absentia, of nine violations under the Environmental Protection Act relating to non-compliance with its Provisional Certificate of Approval. The company was fined $100,000 plus a victim fine surcharge and given 15 days to pay.
Justice of the Peace Moira A. Moses heard the case in the Ontario Court of Justice in St. Catharines and imposed sentence on October 23, 2009.
