Environmental Assessment Laws
The Environmental Assessment Act (EAA) provides for the protection, conservation and wise management of the environment. It applies to activities or projects by public organizations and by non-public entities, if designated by regulation.
Regulations made under the Environmental Assessment Act
- Regulation 334 identifies public organizations which are either subject to or exempt from the EAA depending on the project. The regulation also identifies additional requirements related to the submission of an environmental assessment (EA).
- Ontario Regulation 231/08 - Transit Projects - modifies the EA requirements for public transit projects which are subject to the EAA.
- Ontario Regulation 101/07 - Waste Management Projects - clarifies and modifies EA requirements for waste diversion and disposal facilities such that private and public sector projects are now equally subject to the EAA.
- Ontario Regulation 116/01 - Electricity Projects - modifies the EA requirements for new electricity projects such that private and public sector projects are now equally subject to the EAA.
- Ontario Regulation 616/98 - Deadlines establishes deadlines associated with EAs including Minister's decisions, public notice of submission of an EA, and comment periods on an EA.
- Ontario Regulation 345/93 - Designation and Exemption - Private Sector Developers requires that private sector developers undertaking road, water or sewer projects servicing residential developments under Schedule C of the Municipal Engineers Association Municipal Class EA will complete the same process as a municipality would for those same activities.
