Ontario Regulations 102/94 and 103/94 are a part of the province's 3Rs Regulations. They help businesses and other organizations reduce, reuse and recycle their waste materials.

Who Must Comply?

Office building owners must comply with these regulations if:

• The office building or group of office buildings have a total floor area of 10,000m² or more. A group of office buildings is defined as two or more office buildings with the same ownership located in proximity to one another, with only one other building of different ownership between the two.
• The office building or group of office buildings are located in a municipality that has a population of 5,000 or more.

The Requirements

1. Office building owners are required to:

• Conduct waste audits.
• Develop a waste-reduction work plan and update it annually.
• Put the waste-reduction work plan in place.
• Source separate different types of waste and make reasonable efforts to reuse and recycle it.

2. Compliance with Ontario Regulations 102/94 and 103/94 requires that building management professionals are responsible for three key steps. It's as easy as 1,2,3.

Once you’ve reviewed the Guide to Waste Audits and Waste Reduction Work Plans for the Industrial, Commercial and Institutional Sectors, as well as the Guide to Source Separation of Recyclable Materials for Industrial, Commercial and Institutional Sectors and Multi-unit Residential Buildings, use the Waste Audit (Word file) and Waste Reduction Work Plan (Word file) forms to help guide you through the process.

You are required to document this information under Ontario Regulation 102/94 and to make it available to the Ministry of the Environment if requested. Update these documents annually.

Office buildings that do not fall under this regulation can still use these templates to guide waste-reduction planning efforts.
