Regulations and Compliance
Ontario Regulations 102/94 and 103/94 are part of Ontario’s 3Rs Regulations. They help businesses and other organizations reduce, reuse and recycle their waste materials.
Who Must Comply?
The owner of a retail establishment must comply with Ontario Regulations 102/94 and 103/94 if the establishment:
- is over 10,000 m2 in floor area
- is in a retail shopping complex and has an owner who is solely responsible for waste management
- is located in a municipality that has a population of 5,000 or more
To comply with Ontario Regulations 102/94 and 103/94, owners of qualifying retail establishments are required to:
- Conduct waste audits
- Develop a waste reduction work plan
- Implement the waste reduction work plan and update it annually
- Source-separate certain wastes and make reasonable efforts to reuse and recycle this waste
What if my retail establishment does not have to comply with O. Reg. 102/94 or O. Reg. 103/94?
The Ontario government encourages all retail operations to meet the requirements of the 3Rs regulations to improve waste diversion. This website supports all retail management professionals in their waste-reduction efforts.

3Rs Regulations
The following regulations are part of the Environmental Protection Act and are relevant to your business:
- Waste Audits And Waste Reduction Work Plans (O. Reg. 102/94)
- Industrial, Commercial And Institutional Source Separation Programs (O. Reg. 103/94)

You are required to document this information under Ontario Regulation 102/94 and to make it available to the Ministry of the Environment if requested. Update these documents annually.
