Site Specific Altered Standards

Under O. Reg. 419/05, any new, updated, or more stringent air standard typically has a phase-in period. Phase-in periods were also introduced with the more advanced air dispersion models. The purpose of the phase-in period is to allow facilities time, if necessary, to achieve compliance with the air standard.

A facility that is not able to implement a standard within the phase-in period may request a site-specific alteration of an air standard. Barriers to implementation may include technical, economic, or time-related issues.

The alteration of standard process was developed to establish interim site-specific standards with the goal of continuous improvement of emissions over time.

This risk-based process for determining an altered air standard is set out in O. Reg. 419/05, along with the Guideline for the Implementation of Air Standards in Ontario. Under this process, a facility must demonstrate that it is doing the best that it can reasonably do to reduce the concentrations of the contaminant that is the subject of the request.
