TORONTO - On January 19, 2012, Darwin H. Rubio pleaded guilty to one violation under the Environmental Protection Act for failing to comply with a written notice to submit a vehicle for testing and inspection in connection with the Drive Clean Program.
The Court heard that Mr. Rubio was the owner of a passenger vehicle. In 2010, the ministry became aware that Mr. Rubio's vehicle was not in compliance with emissions legislation, as it had not been tested in over two years. In July 2010, Mr. Rubio was served with a notice requiring him to have his vehicle tested at any of the accredited drive clean testing facilities. He failed to comply with the notice.
Mr. Rubio was charged following an investigation by the ministry's Investigations and Enforcement Branch.
Mr. Rubio was fined $1,500 plus a victim fine surcharge and was given one year to pay the fine.
