Terratec Environmental Ltd. Fined $105,000 For Discharge Into Water

NIAGARA - On March 16, 2012, Terratec Environmental Ltd. pled guilty to one offence under the Ontario Water Resources Act for applying anaerobic digestate that resulted in a discharge to Six Mile Creek causing an adverse effect.

The Court heard that the company applies anaerobic digestate on farmland in Ontario. In November 2009, the company had applied anaerobic digestate to a field in Niagara on the Lake. A few days later, a local resident observed water that was black in nearby Six Mile Creek. Ministry staff attended the site and discovered that a drain located in the corner of the farmland was discharging anaerobic digestate into the creek.

The company was charged following an investigation by the ministry's Investigations and Enforcement Branch.

The company pled guilty to applying anaerobic digestate which resulted in a discharge to Six Mile Creek that caused an adverse effect. The company was fined $105,000 plus a victim fine surcharge and given three months to pay the fine.
