BARRIE — On May 1, 2012, Ewart Orin Garner pleaded guilty to one violation under the Environmental Protection Act for failing to comply with a written notice to submit a vehicle for testing and inspection with respect to the Drive Clean program.
The Court heard that Mr. Garner resides in Barrie and is the registered owner of a 1992 Honda. In September 2009, the vehicle was registered with the Ministry of Transportation, by using false address information to avoid the statutory requirements of the Ontario Drive Clean program. In 2011, it came to the attention of the Ministry of the Environment that the vehicle registration had been renewed by changing the owner’s address to outside the Drive Clean program area. A Provincial Officer of the issued Mr. Garner a notice in February 2011 to submit the motor vehicle for emissions testing. Mr. Garner he failed to do so.
Mr. Garner was charged following an investigation by the Ministry of the Environment’s Investigations and Enforcement Branch.
Mr. Garner was fined $1,000 plus a victim fine surcharge and given 6 months to pay the fine.
