NEWMARKET- On August 20, 2012, 310 Waste Ltd., Rail Cycle Inc., 2020700 Ontario Inc., and 2020780 Ontario Inc. were sentenced and fined a total of $1,100,000. The conviction relates to causing adverse effects to residents as a result of a fire at a waste disposal site.
The Court heard that the companies ran a waste disposal site located in Vaughan. In 2004, a fire occurred at the site and continued to burn for several days, impacting neighboring residences and schools.
In 2008, the companies were convicted, but appealed the conviction and were granted a new trial by the Court.
In the new trial, which commenced in 2010, the companies were convicted of causing or permitting the emission of a contaminant, namely smoke and odour into the natural environment that caused an adverse effect. The companies were fined a total of $1,100,000 plus victim fine surcharges and given 60 days to pay the fine.
