Regulating Biosolids

Effective January 1, 2011, non-agricultural source material (NASM) is managed under the Environmental Protection Act, however it becomes subject to regulation under the Nutrient Management Act if and when it arrives at the farm gate to be used as a nutrient on the farm.

Generators of biosolids must obtain Certificates of Approval issued under the Environmental Protection Act or Ontario Water Resources Act where these approvals are required.

For example, municipal sewage treatment plants are required to obtain approval under the Ontario Water Resources Act. Through this approvals process the ministry ensures that appropriate biosolids stabilization processes are in place at the plant to effectively reduce pathogens. In addition, generators are responsible for conducting sampling and analysis to ensure that their biosolids meet specified quality criteria and for using Ministry of the Environment-approved carriers and receivers for management of their biosolids.

Biosolids haulers require a Waste Management System Certificate of Approval under the Environmental Protection Act. The act requires that Ministry of the Environment approval be obtained before using, operating, establishing, altering, enlarging or extending a waste-management system.
