Purpose
The purpose of this technical update is to inform both laboratories
performing analytical testing for the purpose of compliance to “Soil,
Ground Water and Sediment Standards for Use Under Part XV.1 of the
Environmental Protection Act: Table 6: Soil Extract and Ground Water
Standards to Determine Whether a Property is a Shallow Soil Property”
and those qualified persons requesting such tests, of an interpretive
update
Requirements under Ontario Regulation 153/04
The Record of Site Condition (RSC) – Part XV.1, Ontario Regulation 153/04 made under the Environmental Protection Act, in force October 1, 2004, requires that the analysis of samples taken for the purpose of assessing a contaminant as part of a phase two environmental site assessment or risk assessment or for the purpose of indicating the maximum concentration of a contaminant in, on or under the property in an RSC, be conducted in accordance to Part IX: Site Condition Standards and Risk Assessments
Section 41 of Part IX describes the “extract test”
as follows:
“extract test” means a test conducted in accordance
with the Toxicity Characteristic Leaching Procedure, Method 1311 that
appears in the United States Environmental Protection Agency Publication
SW-846 entitled “Test Methods for Evaluating Solid Waste, Physical/Chemical
Methods”, dated July 1992, as it may be amended from time to time,
or an equivalent test method approved by the Director.
Equivalent Test Method
The Ministry of the Environment has reviewed the Simulated Precipitation Leaching Procedure, Method 1312 that appears in the United States Environmental Protection Agency Publication SW-846 entitled “Test Methods for Evaluating Solid Waste, Physical/Chemical Methods”, dated September 1994, for the purpose of approving its use as an “extract test”.
The MOE has approved this method as a suitable alternate “extract test” which meets the requirements of O. Reg. 153/04, until the regulation is amended to reflect this change.
