Brownfields Redevelopment
What are Brownfields?
Brownfields are lands on which industrial or commercial activity took place
in the past and that may need to be cleaned up before they can
be redeveloped. To encourage redevelopment, Ontario’s
environmental legislation provides general protection from environmental
orders for historic contamination to municipalities, creditors
and others. Current Brownfields legislation provides
property owners with general protection from environmental cleanup
orders for historic contamination after they have appropriately
remediated a site. Ontario’s new Record of Site Condition
Regulation (O. Reg. 153/04) details requirements related to
site assessment and clean up. The regulation replaces the
Guideline for Use at Contaminated Sites in Ontario.

This Guide is intended to provide property owners, consultants (i.e. “qualified persons”), municipalities, building officials, the public and other interested parties with an overview of the new requirements under the EPA and other Acts. The Guide also describes the provisions concerning protection from liability from orders which apply (with certain provisions) to property owners who have filed a record of site condition and to municipalities, secured creditors and others who may need to undertake certain investigative or other actions related to brownfield sites. |
