DAVID MALAYI AND THOMAS NZYIMI CONVICTED UNDER THE
ENVIRONMENTAL PROTECTION ACT

David Malayi and Thomas Nzymi pleaded guilty and were convicted to charges related to a series of illegal dumping incidents in Melancthon Township in Dufferin County. The incidents involved the dumping of waste dyes, high in lead content and classified as hazardous waste.

David Malayi pleaded guilty to three counts under Section 40 of the Environmental Protection Act and one count under Section 21(1) of Regulation 347, and was fined a total of $1,000. Malayi was also placed on 18 months probation with a condition that he complete 200 hours of community service.

Thomas Nzyimi pleaded guilty to one count under Section 21(1) of Regulation 347, and was fined $800.

Section 21(1) of Regulation 347 requires all waste carriers that have possession of waste to have a completed manifest (required form) completed by the generator of the waste accompanying the waste.

The case was heard in Orangeville court by Justice of the Peace Bonnie Walton on May 7, 2003.
