KITCHENER –Scavenger Recycle has been fined $115,000 after being convicted on two counts of failing to comply with conditions of its Certificate of Approval.
925252 Ontario Limited, operating as Scavenger Recycle, runs a waste grease and oil recycling facility in the Town of Elmira. An inspection by the Ministry of the Environment revealed that the company had been receiving waste from outside of its Ontario service area and had not properly labeled storage tanks.
Scavenger Recycle was fined $110,000 for accepting waste from outside of Ontario between February 1, 1999 and November 30, 2000. The Court held that the defendant's importation of waste was motivated out of profit and sentenced the defendant to a fine of $110,000 on this charge ($5,000 per month that the offence continued). The company was fined an additional $5,000 for failing to label all waste storage tanks. Both counts are violations of Section 186(3) of the Environmental Protection Act and were requirements of their Certificate of Approval.
The case was heard in Kitchener court by Justice of the Peace Avis Rodney.
