PICTON - Brian Dekker, president of Dekker Greenhouses Ltd. has been fined $2,250 after pleading guilty to three counts of failing to comply with a Provincial Officer Order following a fuel oil spill.
The Court heard that, on May 15, 2002, Ministry of the Environment staff received reports of fuel oil in ditches near the company’s facility on County Road 28 in Prince Edward County. Further investigation revealed that the material originated from the Dekker property.
On June 11, 2002, a Provincial Officer Order was issued, requiring Dekker and the company to remove and replace the contaminated soil and vegetation within 14 days, and to submit a report outlining work carried out. The Court heard that these requirements were not met.
Brian Dekker was fined $750 on each of three counts under section 186(2) of the Environmental Protection Act for failing to comply with a Provincial Officer Order. A 25-percent victim fine surcharge has been added to the fine.
Justice of the Peace Fred Ross heard the matter, which concluded on June 20, 2003 in the Ontario Court of Justice in Picton.
