BELLEVILLE - Norampac Inc. has been fined $25,000 after being convicted of failing to comply with a Ministry of the Environment requirement to order equipment aimed at phasing out the use of Dombind as a dust suppressant on unpaved roads.
The Court heard that, on April 29, 1999, a Director’s Order was issued under section 18 of the Environmental Protection Act (EPA), setting a series of requirements to phase out the use of Dombind, which contains dioxins.
Condition 2.5 of the Director’s Order required the company to obtain Steam Reformer Technology, the major equipment for treatment to phase out Dombind as a dust suppressant. The Court was told that Norampac Inc. failed to comply with the requirement to order the equipment, thereby contravening section 186(2) of the EPA.
The company was found guilty on April 21, 2003 by Justice of the Peace Cathy Hickling in the Ontario Court of Justice in Belleville. Justice of the Peace Hickling imposed the $25,000 fine – plus a victim fine surcharge – on July 9, 2003.
The conviction and sentence are under appeal.
