MISSISSAUGA – KJH Consultants Inc., a waste transportation company, was fined a total of $30,000 after pleading guilty to three charges under the Environmental Protection Act (EPA). Additionally, Company Director Richard Costa was fined $5,000 after pleading guilty to one charge under the EPA.
The court heard that an inspection conducted by the Ministry of the Environment revealed that KJH had stored construction and demolition waste, as well as used tires on property that the company had rented for equipment storage only. KJH was issued a Provincial Officer Order to remove the waste from the site and to store the tires according to regulation. The company did not comply with the Order within the prescribed period of time.
KJH was fined $15,000 and Richard Costa was fined $5,000, for establishing a waste disposal site without a Certificate of Approval as required under section 27(1)(b) of the EPA. The company was also fined $7,500 for each of two counts of failing to comply with a Provincial Officer Order under section 186(2) of the EPA.
A 25-percent victim fine surcharge has been added to the fines.
Justice of the Peace Hilda Weiss heard the case, which concluded on July 16,
2003, at the Ontario Court of Justice in Mississauga.
